Supreme Court issues notice to EC on plea against separate bypolls to two RS seats

New Delhi, :  The Supreme Court on Wednesday issued a notice to Election Commission and sought a response by June 24 on a plea of the Gujarat Congress challenging the poll panel’s decision to hold separate bypolls for vacant Rajya Sabha seats in the state.
The seats fell vacant following the election of BJP chief Amit Shah and Union Minister Smriti Irani to the Lok Sabha from Gandhinagar and Amethi respectively.
Counsel for Gujarat Congress submitted before the court that there were judgements of Delhi High court passed in their favour.
After the hearing, a vacation bench comprising Justices Deepak Gupta and Surya Kant, listed the matter for June 25.
‘We are not saying anything for now and we need to decide whether it is a casual vacancy or a statutory vacancy. So the matter requires hearing,’ the Bench said.
