High Court Quashes Detention of North Kashmir Youth Under PSA Since 2019

Srinagar, Apr 22,: The High Court of Jammu and Kashmir and Ladakh has quashed the detention of a North Kashmir youth, Irshad Ahmad Dar of Mundji Sopore, who had been languishing in Jail under the Public Safety Act (PSA) since 2019.

Dar, represented by Advocate Bashir Ahmed Tak, was accused of providing logistic support to militants and was arrested in 2019. Advocate Tak submitted before the court that his client’s detention under PSA had already been quashed by the court in December 2019. However, despite the court’s order, Dar was not released.

As per the news agency Kashmir News Trust, the counsel argued that Irshad Dar was arrested twice on the same charges, which he contended was both unlawful and unjustified. He pleaded that the authorities had shown disregard to the court’s earlier ruling, violating the detenue’s fundamental rights.

After hearing detailed arguments and counterarguments, Justice Muhammad Yousuf Wani quashed the detention order and directed the authorities to ensure immediate release of Irshad Ahmad Dar from Srinagar Central Jail. [KNT]
