Passenger Tax Court Sgr Denies Bail to Accused in Fraudulent Migrant Property Sale

Srinagar: Court of Passenger Tax Srinagar has rejected the bail application of an accused for fraudulently selling migrant property worth crores.

As per the news agency CNS, persons privy to the development said that a complainant had presented a written application in Police Station Soura to the effect that in January 2020 he had an agreement with the Ayaz Nabi Bhat son of Ghulam Nabi Bhat, a resident of Upper Buchwara Dalgate, Srinagar regarding land measuring 15 kanals and 14 marlas situated at Srinagar, with the value of the land being fixed.

“Thereafter, an amount of Rs.89,39,600/- was paid and there was an outstanding amount of Rs.2,43,39,600/ which would have been paid once handing over of the land. But, later on it came to know that the said land was a migrant property,” they said.

It was said that the accused Ayaz Nabi Bhat along with other unknown persons entered into the house of the complainant and damaged the doors and windows of his house and also gave him death threats.

“After police received the information, they registered a case FIR No.75/2023 under sections of 420, 451 and 506 of the IPC at the Police Station Soura.”

During investigation, police recorded the statement of several witnesses and it has been proved that the said land is a migrant property and the owner of the property is Shakuntala, wife of Rajinder Kumar, they said, adding that the accused person was arrested on 2nd December 2023.

Later on, counsel for the accused filed an application before the Court on the grounds that the accused was innocent, pleading that the petitioner has no direct or indirect nexus with any kind of offence which would warrant his arrest at the hands of police.

However, the Ld. APP while opposing the bail of the accused said that he was involved in serious offences. “If the accused is released on bail there is every likelihood that he will hamper or temper with the prosecution evidence,” and prayed for rejection of Bail.

“Taking note of all the facts and high magnitude of the case into consideration, I am of the view that the presence of the accused at this stage of investigation with the police concerned is very important as releasing him will encourage him to indulge in such offence in future,” said Sub Judge, Mudasir Farooq, while disposing off the bail application.

Releasing him at this stage would frustrate the investigation as well as shake the confidence of the general public in the judicial system. Therefore, the instant application was rejected, the court ordered.
